How to request a hearing after an unemployment denial

All 50 states plus DC. This guide is about where and how to file the first appeal that gets you to a hearing.

If you got denied unemployment, the next move is usually boring but important: file the appeal and ask for a hearing. You do not need a perfect legal memo. You need a request that gets to the right place before the clock runs out.

This guide covers the first appeal level in 51 jurisdictions. The hearing might be before an ALJ, referee, hearing officer, appeal tribunal, or some other title a state dreamed up. Different name. Same idea.

What to do right after the denial letter shows up

Do these in order. The order matters more than most people think.

1. Find the decision date and the filing instructions

Look for words like appeal, request a hearing, protest, or reconsideration. In several states, the denial notice itself gives the exact mailing address, fax number, or portal path you are supposed to use.

Look for the appeal-rights section first.

2. File first. Build the full story after.

A bare-bones request is usually enough. Missing the deadline is worse than filing a skinny appeal. You can organize records, witnesses, screenshots, and timelines after the request is safely on file.

Do not wait for perfect evidence.

3. Save proof that the request was sent

Keep the portal confirmation screen. Save the fax receipt. If you are mailing it, use something trackable if the deadline is close. The paper trail is not glamorous, but it wins a lot of ugly little fights.

Proof matters when systems go sideways.

4. Keep filing weekly or biweekly claims

Even while the appeal is pending. If you stop certifying, you can win the hearing and still lose weeks of benefits.

This preserves back pay in many states.

5. Watch for the hearing notice and phone instructions

Many first-level unemployment hearings are by phone. Some states make you register a callback number, upload exhibits before the hearing, or ask for interpreter needs in advance. Missing that follow-up step can wreck an otherwise good case.

What your hearing request can say

There is no magic sentence. Clear beats fancy.

In most states, your request just needs to make one thing obvious: you are appealing the decision and you want a hearing. Add your name, claimant ID if you have one, the date of the determination, and a working phone number.

“I appeal the determination dated [date] and request a hearing. I disagree with the decision and want the chance to present evidence. My claimant information and contact information are below.”

Keep the request short, but include the identifiers

Include your full name, the last four digits of your Social Security number if your state asks for it, the date of the decision, your mailing address, and a phone number that will still work when the hearing notice arrives.
